United States Second Circuit

United States v. Vilar, 10-521

Defendant's motion to withdraw his direct criminal appeal with leave to reinstate it after he has finished pursuing an application for habeas relief or, in the alternative, a six-month extension to file his appellate brief is denied with respect to motion to withdraw but granted with respect to extension because judicial economy and fairness favor denial, while an extension will not seriously prejudice the government or co-defendant.
