In a dispute arising from a petition for review of an order of removal, motion to dismiss petition on the grounds of the fugitive disentitlement doctrine is denied where the application of the doctrine to petitioner’s failure to appear on a bag-and-baggage notice will improperly conflate disobedience of an executive command with that of a court order.
