In Re: Enron Creditors Recovery Corp. v. Alfa, SAB de CV, 09-5122
In a bankruptcy dispute involving the application of 11U.S.C. section 546(e) and whether section 546(e) protects from avoidance pre-petition payments made to redeem, prior to maturity, certain outstanding commercial paper, judgment of the district court is affirmed where such payments were settlement payments and thus were protected from avoidance under section 546(e).
