Calabro v. Aniqa Halal Live Poultry Corp., 10-66
In a state action for invasion of privacy, NY Civil Rights Law Sections 50 and 51, and involving counter-claims for breaches of the False Claims Act, 31 U.S.C. section 3729 et seq., and the Poultry Products Inspection Act, 21 U.S.C. section 451 et seq, judgment of the district court remanding case to state court and awarding attorney's fees is affirmed, because there is no appelate jurisidction on remand order but where court did not abuse discretion in awarding fees.
