United States Second Circuit

Kuebel v. Black & Decker (U.S.) Inc., 10-2273

In a labor and employment dispute alleging commute time and off-the-clock violations under the Fair Labor Standards Act and New York Labor Law, summary judgment in favor of defendant is affirmed in part and reversed in part because district court properly granted summary judgment on the commute time claims, but erred on plaintiff's off-the-clock claims since there are genuine issues of material fact.
