Taylor v. Housing Authority of the City of New Haven, 10-1144

In a class action arising from the provision of Section 8 housing and alleging discrimination in violation of the Fair Housing Act, 42 U.S.C. section 3604(d), judgment of the district court in favor of defendants is affirmed where district court: 1) properly held that 24 C.F.R. sections 8.28 and 100.204 may not be privately enforced through 42 U.S.C. section 1983; 2) properly analyzed intentional discrimination claim under the FHAA; 3) committed no errors in factual findings regarding the provision of Section 8 services to the class; and 4) properly decertified class.
