Luna v. Holder, 08-4840

In a petition for review filed more than 30 days after the order of removal, petition is denied because applying the 30-day filing deadline to the challenge by defendant, a native of Jamaica, does not violate the Suspension Clause where the statutory motion to reopen process is an adequate and effective substitute for habeas review.
