In an action seeking damages under the Fair Debt Collection Practices Act's (FDCPA) civil liability provisions, 15 USC section 1692k, the district court's grant of defendant's motion to dismiss is vacated where defendant has violated the FDCPA's venue provisions by suing a consumer in a city court when that court lacks power to hear the action because the consumer did not reside in that city or a town contiguous to it.
