US v. Chowdhury, 09-3442

Conviction and sentence conviction for possession with intent to distribute 1-Benzylpiperazine (BZP) in violation of 12 U.S.C. section 846, are affirmed where: 1) the District Court did not err when it determined that the controlled substance referenced in the U.S.S.G. that is most closely related to a mixture of BZP and 3-triflouromethylphenyl (TFMPP) is 3,4-Methylenedioxymethamphetamine (MDMA), or ecstasy; and 2) the sentence imposed was not procedurally unreasonable.
