In a First Amendment right to free speech case involving a preacher at a pedestrian mall, alleging a violation after police officer issued plaintiff a written warning pursuant to city noise control ordinance, Burlington, VT, Code of Ordinances section 21-13(b)(1) (2003), grant of summary judgment to officer and grant of defendants' motion to dismiss remaining claims are affirmed, as the ordinance is found to be constitutional as-applied.
