US v. Acoff, 10-285

Sentence for conviction of possessing five or more grams of cocaine base with intent to distribute, in violation of 21 U.S.C. section 841, is vacated where the district court manifestly erred in sentencing defendant to a term below the statutory minimum, even in light of intervening congressional legislation that reduced sentences for certain crack cocaine offenses.
