United States Second Circuit

US v. Rojas, 09-3007

Defendant's drug conspiracy conviction is affirmed where: 1) it was proper for the district court to recall the jury, after it had been declared "discharged" but before it had dispersed, in order to correct a misreading of the written verdict form and to re-poll the jury; and 2) the fact that a buyer-seller relationship existed between co-conspirators did not insulate a buyer from a conspiracy charge "if the facts support such a charge."
