United States Second Circuit
Scheffer v. Civ. Serv. Employees' Ass'n, 07-3683
In an action by public-sector employees who, as nonmembers of the union that represented them for collective-bargaining purposes, challenged organizing fees assessed by the union, the dismissal of the complaint is affirmed in part where the union's fee calculation and disclosure procedures were constitutional. However, the judgment is reversed in part where charging nonmembers for the organizing expenses at issue violated their First Amendment rights.
