Ragone v. Atlantic Video, 08-4666

In a sexual harassment action, dismissal of the complaint and a grant of defendant's motion to compel arbitration are affirmed where: 1) the fact that plaintiff was offered the arbitration agreement on a "take it or leave it" basis did not render it unenforceable; and 2) defendant agreed to waive any potentially unconscionable terms of the agreement.
