US v. Savoy, 08-4900

District court order granting in part and denying in part defendant's motion for a reduction in sentence is affirmed where: 1) the district court lacked the authority when reducing a sentence pursuant to 18 U.S.C. sec. 3582(c)(2) to reduce that sentence below the amended Sentencing Guidelines range; and 2) the original sentence fell within the applicable pre-amendment Guidelines range.
