United States Second Circuit

Capital Ventures Int'l v. Republic of Argentina, 07-1551

In an action involving bonds issued by Argentina, district court's dismissal of plaintiff's claims for lack of subject matter jurisdiction is affirmed in part and reversed in part where: 1) the court has subject matter jurisdiction over the plaintiff's claims relating to the German bonds because Argentina explicitly waived its sovereign immunity to suit when it offered circulars with the bonds; and 2) district court correctly determined that no statutory prejudgment interest payments became due on the U.S. dollar denominated bonds after the bonds had been accelerated.
