In an action challenging a merger of the National Association of Securities Dealers and the New York Stock Exchange, appeal of the district court judgment dismissing the suit is declared moot where the Court of Appeals for the Ninth Circuit dismissed a petition for review of the SEC order regarding the merger, eliminating the essential controversy from the appeal. Case is dismissed without prejudice to the right of any party to pursue any substantive issues sought to be raised on this appeal in the event of a subsequent appeal from a final judgment of the district court.
