United States Second Circuit

Jones v. West, 071313

In conviction on four counts of robbery in the second degree, denial of petition for writ of habeas corpus is reversed and remanded where: 1) the state courts unreasonably applied Batson v. Kentucky with respect to the prosecutor's peremptory strike of a black prospective juror; and 2) the petition for habeas corpus relief should have been granted.
