Espinal v. Goord, 070612
In a claim brought by prison inmate against the state department of correctional services (DOCS) for use of excessive force and denial of medical treatment in violation of the Eighth Amendment, grant of summary judgment in favor of defendant is affirmed in part, reversed in part, and remanded where: 1) The DOCS' grievance procedures did not require inmates to specifically name responsible parties; and 2) plaintiff-inmate did not fail to exhaust his administrative remedies by omitting the names of defendants from his prison grievance.
