Capital Ventures Int'l v. Republic of Argentina, 07-1551
In an action brought against Argentina by an owner of bonds issued by defendant seeking payment and interest on certain bonds, dismissal for lack of subject matter jurisdiction of claims relating to bonds issued by defendant under German law, and a ruling against plaintiff on its claim for statutory prejudgment interest on certain unpaid interest payments, are affirmed in part and vacated in part where: 1) there was subject matter jurisdiction over claims relating to German bonds because Argentina explicitly waived its sovereign immunity to suit in U.S. courts on those claims; and 2) the district court correctly determined that no interest payments became due on U.S. bonds after they had been accelerated.
