Following an action to compel adjustment of plaintiff's status to that of a lawful permanent resident on the basis that U.S. Citizenship and Immigration erroneously denied his application, denial of plaintiff's application for attorney's fees and costs is affirmed where plaintiff was not a "prevailing party" within the meaning of the Equal Access to Justice Act.
