Sharkey v. Quarantillo, 061397

In claim alleging that the U.S. Citizenship and Immigration Services had granted lawful permanent resident status to the plaintiff then rescinded that status without following the mandatory regulatory rescission procedures, decision in favor of defendant-state immigration services is reversed and remanded where: 1) the district court erred by dismissing the complaint for lack of subject matter jurisdiction; and 2) the complaint states a claim upon which relief can be granted.
