Appeal from final judgment dismissing petitioner-s motion, for return of his daughter to Chile, for lack jurisdiction is affirmed where the petitioner did not actually possess custody rights at the time of his daughter-s removal to the United States, such as to allow him to seek return of her, under the Hague Convention, implemented by the International Child Abduction Remedies Act.
