United States Second Circuit

US v. Ramirez-Sucar, 06-2909

Sentence imposed based on guilty plea to unlawfully entering the U.S. is affirmed where the district court did not err in refusing to find that the existence of "fast-track" departures from Guidelines sentence calculations creates an unwarranted sentencing disparity.
