Walcott v. Chertoff, 06-5516

BIA decision holding that, under the AEDPA, petitioner's aggravated felony conviction made him ineligible for discretionary relief from deportation under former section 212(c) of the INA is vacated to allow petitioner to assert a claim of reliance under Restrepo v. McElroy, 369 F.3d 627, 634-35 (2d Cir. 2004), which if proven before an IJ would make AEDPA's section 440(d) impermissibly retroactive as applied to him.
