Delgado v. Mukasey, 06-5035
Petition for review challenging decision by the Immigration & Customs Enforcement reinstating order of removal against petitioner is denied over petitioner's claims that: 1) she applied for adjustment of status with the Citizenship & Immigration Services under 8 U.S.C. section 1255(i) on a date preceding the issuance of the reinstatement order; 2) she is eligible to have her status adjusted to that of a lawful permanent resident; and 3) she is eligible for adjustment of status with a waiver under 8 C.F.R. section 212.2(e), which "cures" her inadmissibility.
