In case involving eminent domain and a proposed stadium for the New Jersey Nets, dismissal of complaint alleging that eminent domain action violates the Public Use Clause of the Fifth Amendment is affirmed as the plaintiffs have not mounted a viable Fifth Amendment challenge.
