New York Mercantile Exch., Inc. v. IntercontinentalExchange, Inc., 05-5585
In a suit to determine whether plaintiff-exchange can enforce a copyright in the settlement prices it produces to value customers' open positions on futures contracts, summary judgment for defendant is affirmed where: 1) the merger doctrine applies such that enforcing the copyright on the prices here would effectively accord protection to the idea itself; and 2) the district court did not abuse its discretion in declining to exercise supplemental jurisdiction over defendant's state law claims.
