In Re: Andrew A. Hyman, 05-7026
A bankruptcy court's ruling that collateral estoppel based on findings in prior proceedings did not preclude relitigation of a non-dischargeability claim is affirmed where the previous court made no findings concerning the debtor's state of mind when he breached a fiduciary duty that would be relevant to the legal issues involved in creditor's claim.
