Merrill Lynch & Co. v. Allegheny Energy Inc., 05-5129
In contract dispute, multi-million-dollar judgment for plaintiffs is reversed in part where the legal arguments relied on by the district court and the inferences it drew were insufficient to hold that plaintiffs substantially performed under the Purchase Agreement, in terms of warranties relating to the quality and nature of the information it had provided defendants, at the summary judgment stage.
