Strom v. Siegel Fenchel & Peddy P.C., 06-3107

In plaintiff's ERISA suit against her former employer, defendant law firm, partial grant of summary judgment on claims of entitlement to benefits under pension plans administered by the firm is vacated where: 1) the plan administrators failed to offer any interpretation of the plans' terms to which the district court might have accorded deference in granting summary judgment; and 2) the district court erroneously held that plaintiff had waived her claim under one of the plans by failing to exhaust her administrative remedies, of which remedies she was never informed by defendant.
