United States Second Circuit
N.Y. Mercantile Exch., Inc. v. IntercontinentalExch., Inc., 05-5585
In dispute over ability to enforce copyright in plaintiff's settlement prices it produces to value customers' open positions, judgment granting summary judgment for defendant, denying plaintiff's cross-motion for partial summary judgment, and declining to exercise supplemental jurisdiction is affirmed as: 1) there is no infringement as enforcing the copyright here would effectively accord protection to the idea itself; and 2) dismissal of defendant's state law claims was not an abuse of discretion.
