Zellner v. Summerlin, 05-6309
In suit for false arrest, malicious prosecution, and excessive force, order granting judgment as a matter of law in favor of defendants is reversed as to the false arrest and malicious prosecution claims where the the district court erred by making factual findings adversely to plaintiff, rather than viewing the record in the light most favorable to him.
