In case involving the payment of more than $400 million in property loss in the destruction of 7 World Trade Center, a building adjacent to the Twin Towers that collapsed from fire on September 11, 2001, dismissal of insurer subrogee's claim of gross negligence -- in the form of a diesel-fuel-powered generator system that pumped fuel through the entire building at all times and aggravated the fire damage -- against defendants is affirmed, however, plaintiff's motion for partial vacatur is remanded to the district court to consider in the first instance issues regarding assumption of the risk and collateral estoppel.
