Iqbal v. Hasty, 05-5768

In case raising issues regarding the defense of qualified immunity for government officials in the aftermath of the events of 9/11, denial of motions to dismiss complaint is reversed where qualified immunity cannot be sustained as to any defendants at this preliminary stage of the litigation except as to the claim of violation of procedural due process rights.
