United States Second Circuit

Gagliardo v. Arlington Cent. Sch. Dist., 06-1494

In suit under the Individuals with Disabilities in Education Act for reimbursement of tuition expenses incurred in educating their child at a private school of their choosing, summary judgment for plaintiffs is reversed as the district court's decision to reject the Impartial Hearing Officer's determination regarding the appropriateness of the private school chosen by the parents is not supported by the record.
