United States Second Circuit
US v. Chirino, 06-1207
Conviction and sentence of defendant, a previously convicted felon on probation, based on conditional plea to possessing of a firearm are affirmed over claims that the district court should have granted his motion to suppress: 1) the firearm, discovered in his dresser drawer during a warrantless search; and 2) a statement made in the course of his arrest after finding the gun, as it was a product of that search not supported by reasonable suspicion.
