Denial of appellant's state sovereign immunity defense to bankruptcy proceedings brought under 11 U.S.C. section 304 by appellee, the foreign bankruptcy administrator of two banks of the former State Union of Serbia and Montenegro, is affirmed primarily where a prima facie case exists for permitting suit under Ex parte Young.
