United States Second Circuit

US v. Giffen, 05-5782

Interlocutory appeal by the government challenging the denial of the government's motion to preclude the defendant from raising a public authority defense during a trial for bribery, fraud on the Republic of Kazakhstan, money laundering and tax offenses is dismissed for lack of jurisdiction where the appeal was premature since the district court's order did not authorize the disclosure of confidential information.
