United States Second Circuit
E.I. Dupont De Nemours & Co. v. Invista B.V., 06-4082
In a case involving sale of plaintiff's nylon fiber business to defendant, and defendant's agreement not to acquire any company in the nylon resin business, motions to dismiss appeal as moot and to vacate denial of motion for injunctive relief are granted over defendant's claims that voluntary cessation of allegedly illegal conduct does not make a case moot, and that its openness to future transactions involving similar companies presents a live dispute regarding the terms of the purchase agreement.
