United States Second Circuit

On remand from the U.S. Supreme Court, in light of the DOL's Wage and Hour Advisory Memorandum No. 2005-1, the original decision is adhered to, and thus, ruling that 29 C.F.R. section 552.6 is enforceable on its face is affirmed, and ruling that 29 C.F.R. section 552.109(a) is enforceable is vacated.
