Levine v. Apker, 05-2590

Denial of habeas petitions, challenging a policy and a regulation of the Bureau of Prisons that limit petitioner's placement in a community corrections center to the lesser of the last ten percent or six months of his sentence of imprisonment, is vacated. In transferring an inmate to a CCC or any "available penal or correctional facility," the BOP must consider the factors set forth in 18 U.S.C. section 3621(b), without reference to 28 C.F.R. section 570.21.
