In an action involving a competitive local-exchange carrier's (CLEC's) challenge to acquire a portion of the incumbent's market share, the Vermont Public Service Board's decisions that: 1) Board determined local calling areas would continue to control whether a call is a toll call or a local call; and 2) plaintiff is prohibited from offering virtual NXX service, are affirmed where the Board properly exercised jurisdiction over these matters and properly applied The Telecommunications Act of 1996.
