United States Second Circuit

Lin v. US Dep't of Justice, 02-4713

In an appeal of a denial of application for political asylum and for withholding of removal, despite inconsistencies in petitioner's testimony, the errors in the IJ's analysis permit the granting of a petition for review and remanding to the BIA for reconsideration of her claim. All other claims are either meritless or lack jurisdiction.
