Pan v. US Attorney Gen., 04-5265

Petition for review of denial of application for asylum, withholding of removal, and relief under the Convention Against Torture, is granted where the agency failed to: 1) determine whether petitioner's status as a boyfriend and father qualifies him as a refugee; and 2) reach a definitive general credibility finding regarding petitioner's testimony and supporting statements and to determine whether petitioner has established a credible claim of past persecution.
