United States Second Circuit
Pang v. Bureau of Citizenship and Immigration Servs., 03-40333
Denial of application for asylum and withholding of removal is vacated where the IJ erred in: 1) relying on inconsistencies arising from application to reach an adverse credibility determination, without considering evidence that petitioner was unaware of application's contents; and 2) failing to give petitioner adequate opportunity to address what the IJ viewed as inconsistencies in the applicant's testimony.
