Leibowitz v. Cornell Univ., 05-0868

Order dismissing employment discrimination and breach of contract claims for failure to state claims upon which relief can be granted is vacated where the district court incorrectly applied a heightened pleading standard. Dismissal of for breach of implied contract and quantum meruit claims are affirmed as plaintiff failed to plead necessary elements of those claims.
