Martinez v. Port Auth. of New York & New Jersey, 04-6636

Award of $464,000 in damages on plaintiff's false arrest and malicious prosecution claims, after plaintiff accepted a remittitur of the $1,104,000 in damages awarded by the jury, is affirmed over claims that: 1) the remitted award was disproportionate to the emotional injury; 2) the jury instructions permitted plaintiff to recover for duplicative damages; and 3) the court's breakdown of award into segments distorted calculations.
