Securities & Exch. Comm'n v. Cavanagh, 04-5402

Grant of summary judgment in favor of plaintiff in a securities law enforcement action is affirmed over claims that the district court erred by 1) refusing to apply 15 U.S.C. section 77d(1) to exempt defendants from the securities registration requirement of 15 U.S.C. section 77e; and 2) imposing a disgorgement remedy that defendants allege is beyond the power of the federal courts.
