The district court erred in failing to: 1) dismiss or stay a suit brought under 47 U.S.C. section 401(b) to enforce an FCC order requiring defendant to comply with the cross-ownership rule because it owns a daily newspaper and two television stations; and 2)to refer the matter to the FCC under the primary jurisdiction doctrine.
